			<content:encoded><![CDATA[<p>It&#8217;s hard to tell whether this man&#8217;s legitimately concerned about access for people with disabilities, or if he&#8217;s going for a Guinness World Record in successful lawsuits. <span id="more-466"></span></p>
<p>If your company every comes across Jarek Molski, you might want to speak to a lawyer, pronto. Injured in a motorcycle accident nearly two decades ago, Molski has figured out the best way to take advantage of the Americans with Disabilities Act (ADA). According to California legal records, he&#8217;s filed 400 suits against businesses that don&#8217;t follow disability-access rules to the letter.</p>
<p>Because he&#8217;s confined to a wheelchair, Molski sues &#8212; and usually collects from &#8212; business that aren&#8217;t up to code. The fines for violating the ADA can run nearly $4,000 a day, and business owners can choose to pay the fines, pay for renovations to get their establishments up to code or settle out of court with Molski.</p>
<p>A federal judge has banned Molski from filing any lawsuits in the Central District of California, but that doesn&#8217;t mean his spree is over &#8212; he&#8217;s free to press his luck anywhere else in the U.S.</p>

<p>When North Port, FL, police officers responded to a reported shooting and robbery, it didn&#8217;t take long for them to see something wasn&#8217;t right. John &#8220;Richard&#8221; Lynn had been shot in the chest, and told officers two people stole his wallet and money while putting a gun to his chest. According to Lynn&#8217;s statement, he knocked the gun away from his head and was immediately shot in his chest.</p>
<p>But Lynn couldn&#8217;t explain why he still had his wallet and identification on him when police officers arrived. After being airlifted to a nearby hospital for treatment, detectives discovered the gun Lynn had been shot with &#8212; along with his fingerprints on the weapon. He&#8217;d shot himself to obtain disability benefits.</p>
<p>Lynn was charged with filing a false police report, possession of a firearm by a convicted felon and violating probation.</p>

<p>When Boston firefighter Albert Arroyo was granted accidental disability retirement, his supervisors probably envisioned him taking it easy &#8212; plenty of rest, some therapy sessions, etc.</p>
<p>Finishing eighth in the 2008 Pro Natural American Bodybuilding Championships? Probably not the first thing that sprang to mind.</p>
<p>But that&#8217;s exactly what happened. After Arroyo claimed six weeks of his full salary tax-free because he was &#8220;totally and permanently disabled,&#8221; fire commissioner Roderick Fraser learned of Arroyo&#8217;s training regimen and record as a bodybuilder.</p>
<p>When asked how he could claim disability while performing in the rigorous physical competitions, Arroyo told the commissioner that &#8220;bodybuilding helps ease the back pain.&#8221;</p>
<p>His boss&#8217;s response: &#8220;If he can lift weights, work out constantly, and enter bodybuilding contests, then he can inspect a building.&#8221;</p>
<p>This incident couldn&#8217;t have been at a worse time for Boston &#8212; a federal grand jury has been issuing scores of subpoenas to the city&#8217;s firefighters as part of a criminal investigation into years of questionable injury claims.</p>
<p>Of course, after looking at Arroyo&#8217;s claim, it&#8217;s easy to see that something wasn&#8217;t right: He reported he&#8217;d had an accident that no one witnessed, at a firehouse where he wasn&#8217;t assigned.</p>

			<content:encoded><![CDATA[<p>Companies of all sorts have to make accommodations for disabled employees and customers. Here&#8217;s a request we&#8217;ve never heard before. <span id="more-160"></span></p>
<p>A group of Santa Fe residents is taking the city to court over its WiFi Internet systems installed in public buildings.</p>
<p>The residents claim they&#8217;re &#8220;allergic&#8221; to the wireless signal and that the city&#8217;s violating the Americans with Disabilities Act (ADA) by effectively limiting their access to those Internet-laced buildings.</p>
<p>Don&#8217;t get us wrong &#8212; ADA cases involving sensitivity to perfume, air fresheners and other chemicals have made it to court with varying results. But so far, no court has ever ruled on whether so-called &#8220;electro-sensitivity&#8221; can be considered a disability under the law.</p>
<p>Experts say it&#8217;s unlikely for companies to be sued over this issue, but stranger things have certainly happened. If electro-sensitivity ever gets legal protection, employers would be in big trouble, since many companies run their own WiFi networks.</p>

<p>Keith McNiffe, former mayor of Pembroke in western Wales, claimed state disability benefits for two years because he was &quot;too ill to walk.&quot;</p>
<p>Apparently, he wasn&#8217;t &quot;too ill to run around in a striped shirt,&quot; because he officiated at 67 football games during that time.</p>
<p>The 49-year-old stepped down as mayor to fight the accusations. He soon admitted to not notifying the proper authorities of his improved health.</p>
<p>McNiffe collected nearly $18K over the two years, which he has to pay back. But that&#8217;s not the only punishment he&#8217;s getting. He&#8217;s been sentenced to a four-month stint in jail, suspended for 18 months and he has to pay almost $150.</p>
<p>Here&#8217;s the kicker (pun intended) &#8212; along with all that he has to complete 200 hours of unpaid work and gets to sport a criminal record.</p>
